Terms of Service

The agreement between you and Eurosia Systems OÜ when you use EurosiaPay.

1. About these terms

These Terms of Service (the “Terms”) form a binding agreement between you (the “User”) and Eurosia Systems OÜ, a private limited company registered in Estonia (registry no. 16523847, VAT EE102538476), operating the EurosiaPay product and brand (“EurosiaPay”, “we”, “us”).

By creating an account, downloading the mobile application, or making a payment through any EurosiaPay channel, you confirm that you have read, understood, and agreed to these Terms.

2. Eligibility

  • You must be at least 18 years old.
  • You must reside in a jurisdiction where the use of crypto-asset payment services is lawful and where EurosiaPay is offered.
  • You must not be a sanctioned person under EU, UN, OFAC, UK or other applicable sanctions regimes.
  • Business users must provide accurate beneficial ownership information and pass our enhanced KYB review.

3. The service

EurosiaPay enables consumers to pay merchants in fiat currency (EUR/USD) using crypto-assets as a funding source, and merchants to receive settlement in fiat currency or crypto. The service is operated through licensed and regulated partners under the EU MiCA framework and applicable EMI/PI partners.

Conversion rates are sourced from the European Central Bank reference rate plus a transparent spread disclosed at checkout. The locked rate is honoured for a defined window displayed in the app.

4. Fees

Applicable fees, FX spreads, and settlement rails are listed on the pricing page and inside the application before each transaction. We may amend fees with at least 30 days notice for existing users, sent by email and in-app.

5. Customer obligations

  • Provide accurate identification and ongoing due diligence data.
  • Keep your credentials, device, and recovery materials secure.
  • Not use EurosiaPay for any illegal or sanctioned activity.
  • Not attempt to reverse-engineer or interfere with the service.

6. Suspension and termination

We may suspend, restrict or terminate your access at any time if we reasonably suspect a breach of these Terms, regulatory non-compliance, fraudulent activity, or risk to other users. We will inform you unless prevented by law.

7. Liability

To the fullest extent permitted by law, our aggregate liability is limited to the fees paid to us in the 12 months preceding the event. We are not liable for losses arising from third-party rails (banking, blockchain, or card networks) outside our reasonable control.

8. Custody and insurance

Crypto-asset balances are held in segregated MPC custody operated by regulated partners. €150M custody insurance · Lloyd's of London syndicate.

9. Disputes and governing law

These Terms are governed by Estonian law. Disputes shall be resolved before the courts of Harju County, Estonia, without prejudice to your mandatory consumer protection rights under your local jurisdiction.

10. Changes

We may update these Terms from time to time. Material changes are communicated by email and in-app. Continued use after the effective date constitutes acceptance of the new Terms.
